    ISLAMABAD: Two judges of the Supreme Court, Justice Mansoor and Justice Jamal Mandukhel, have come out with a dissenting note on the decision of the election case. The broad powers of justice should be reviewed.

    According to Express News, the Chief Justice of the Supreme Court, Justice Umar Atta Bandyal, had taken notice of the elections in Punjab and KP within 90 days. In Khawa, which had ordered the elections to be held within 90 days, the two judges on the then larger bench disagreed on the decision and the suo motu notice, whose written decision has come out today.

    Justice Mansoor Ali Shah and Justice Jamal Khan Mandukhel had dissented in the written judgment related to the Punjab KP election and said that the Chief Justice of Pakistan has broad powers to take ex officio notices and create special benches, which led to the Supreme Court Criticized and devalued, it is the right time to reconsider one’s broad powers.

    In the detailed decision, the judges have said that the law does not allow judges to be removed from the bench against their will, while giving their decision, the two honorable judges left the issue of staying in the bench or not to the discretion of the Chief Justice, but their decision Included in the final decision at the end of the case.

    The judges have said that there is a need to regulate the authority of the Chief Justice as the entire court cannot be left to one person, the jurisdiction of the court is determined by the constitution and not by the whim and convenience of the judges.


    It is stated in the dissenting note that the judicial jurisdiction determines the nature of the case and not the interests connected with it. Yes, it has to be ensured that the power of the Parliament is not limited by the decisions of the Supreme Court.

    The judges have said in the judgment that it is high time to re-examine the powers of the Chief Justice of Pakistan to enjoy a one-man show. Pakistan’s powers should be governed by laws made by the Full Court.
